Terms of Service

1. Introduction

These Terms of Service (hereinafter referred to as "Terms") constitute a legally binding agreement between Holiday Light KC (hereinafter referred to as the "Company," "we," "us," or "our") and the customer (hereinafter referred to as the "Customer," "you," or "your") for the provision of temporary Christmas lighting installation services on your property. By using our services, you agree to abide by these Terms.

2. Services

2.1 Scope of Work:

We will provide temporary Christmas lighting installation services as described in the service order or proposal provided to you. The scope of work may include the installation, maintenance, and removal of Christmas lights and associated materials.

2.2 Access to Property:

You agree to provide our technicians with safe and unobstructed access to the residential property for the purpose of installation and removal of Christmas lights.

3. Pricing and Payment

3.1 Quotation:

The pricing for our services will be based on the quotation or proposal provided to you by Holiday Light KC. The quotation will include a breakdown of costs, including installation, maintenance, and removal. Prices are guaranteed for a three-year period. After the period expires, prices may be subject to adjustment to account for inflation.

3.2 Deposit:

A non-refundable deposit of 50% of the total quoted price is required at the time of accepting the quotation to secure your booking for our services. The remaining balance will be due upon completion of the installation services, unless otherwise specified in the quotation.

3.3 Payment:

We accept payment for the deposit and balance by cash, check, credit card, or other payment methods as agreed upon.

3.4 Lease of Christmas Lights:

You acknowledge and agree that the Christmas lights provided as part of our services are leased to you for the duration of the service period. The ownership of the Christmas lights remains with Holiday Light KC. You shall not acquire any ownership interest in the Christmas lights.

3.5 Return of Christmas Lights:

At the end of the service period or upon cancellation of our services, you agree to return the Christmas lights in the same condition as received, normal wear and tear excepted. Failure to return the Christmas lights may result in additional charges as specified in the quotation or lease agreement.

3.6 Damages or Loss:

You are responsible for any damages to the Christmas lights during the service period, excluding normal wear and tear. In the event of loss or damage beyond normal wear and tear, you agree to compensate us for the replacement or repair costs of the Christmas lights, as determined by Holiday Light KC.

4. Scheduling and Weather

4.1 Scheduling:

We will work with you to schedule the installation and removal of Christmas lights at a mutually convenient time. While we will make every effort to meet the agreed-upon schedule, we cannot guarantee specific installation or removal dates due to weather and other factors beyond our control.

4.2 Weather Delays:

In the event of inclement weather or unsafe working conditions, we may need to reschedule the installation or removal. We will communicate any delays or rescheduling promptly.

5. Warranty and Maintenance

5.1 Warranty:

We offer a limited warranty on the Christmas lights and installation for a period specified in the quotation. This warranty covers defects in materials and workmanship but does not cover damage caused by accidents, negligence, or vandalism.

5.2 Maintenance:

You agree to promptly notify Holiday Light KC of any issues with the Christmas lights, and we will make reasonable efforts to address and rectify any problems within the warranty period.

6. Removal of Christmas Lights

6.1 Removal:

We will remove the Christmas lights at the end of the agreed-upon service period. If you wish to remove the lights earlier than scheduled, please notify us in advance.

7. Media and Publicity

7.1 Photography and Social Media:

Holiday Light KC may take photographs of the residential property with the installed Christmas lights for promotional and marketing purposes. By agreeing to these Terms of Service, you grant us permission to use these photographs on our website, social media accounts, promotional materials, and other marketing channels.

7.2 Opt-Out Option:

If you prefer that your property not be featured in our promotional materials, please notify us in writing at the time of accepting the quotation.
